Terms And Conditions Of Services

GIT Information Center Service Agreement

This service agreement (hereinafter referred to as “the Agreement”) sets out the terms and conditions on uses of the services of https://infocenter.git.or.th/ or other means which are controlled and provided by GIT Information Center (hereinafter referred to as “GIT”) to users (hereinafter referred to as “you” or “the user”).

Thus, when you use the services through an application, a website, or any other service channel of GIT, it shall be deemed that you, as a user of GIT, have read, understood, and voluntarily agreed to comply with the terms and conditions of the services according to the Agreement and relevant regulations and laws.


1. Definition

“GIT Information Center” means sale or service provided through an application, a website or other channel under the control or responsibility of GIT.


2.  Accessing GIT Services and Creating User Account

2.1 An individual who wishes to use services of GIT must sign up for a user account with GIT by registering a username; set up a password; provide accurate, complete, and true information related to him/herself through registration on a website and/or an application of GIT; and rectify account information to keep it true and updated or if there is any change.

2.2 The user is obliged to keep his/her username and password confidential and prevent any third party to access or wrongfully use his/her account. The user agrees that after using services of GIT on any channel, the user shall log out of the system immediately to prevent theft or stealing of a password. If you, your username and/or password suffer any damages, you agree to bear all damages by yourself.

2.3 To ensure the security, setting up your password as a user must contain a minimum of 6 characters, which include uppercase letters, lowercase letters, numbers, and at least 1 special character. If you have set a password which is too simple or insecure and causes theft or stealing of password, you agree to take full responsibility to all damages by yourself.

2.4 In order to register and sign up for a user account with GIT, you must be at least 18 years of age or older or reach legal age according to the law and have legal ability to enter into a binding legal agreement. If you are under 18 years old or not of a legal age, GIT has the right to request for an evidence of consent in signing up for a user account from your guardian who is authorized to act on your behalf. If the guardian refuses to provide the consent document after having been requested by GIT or you cannot provide the consent of your guardian, GIT has to decline your membership or cancel your membership.

2.5 In the event that GIT finds that any user provides false information, GIT reserves the right to suspend or revoke the account or suspend your use of GIT’s service immediately and such action shall be deemed as breach of agreement. You must bear civil and criminal liabilities to all damages occurred from such action.

2.6 You agree that you shall not permit or involve in or consent to allowing any third party that is not the owner of the user account to use your account or an account of other individual, whether wholly or partly. If such circumstance is found by GIT or GIT finds that the use of the account violates the Agreement or any terms and conditions of GIT, GIT has the rights to revoke or suspend the use of your account and the accounts of all of the related users, as well as terminate the Agreement. 

2.7 If it is found that a third party has used your account without permission from GIT, you are obliged to inform GIT immediately. In the case that GIT has used appropriate expertise and precaution, GIT reserves the rights not to be liable for any damages as well as damages occurred from the user’s account or password.


3. Terms of Service

3.1 You agree to use the services solely for your personal interests, not for any business or commercial benefits, whether directly or indirectly, unless you have agreed otherwise to GIT.

3.2 You accept that in order to access to the services and products under the control of GIT, you must proceed only through means and methods provided by GIT.  

3.3 You agree not to commit any acts which violate GIT or cause damages to GIT, whatever the reason may be, e.g. copying, duplicating, modifying, or distributing products presented on the website or application of GIT; reverse engineering, decoding, modifying, altering, or any method to the service system or application of GIT to access the services or products of GIT without permission, or using any software or application which is not provided by GIT to use the services under the Agreement; or trying to commit or help a third party commit any act that violates the terms and conditions under the Agreement, unless you have made an agreement otherwise with GIT.

3.4 You have clearly read and understood that by using the services of GIT, you are obliged to prepare electronic devices related to the services by yourself (e.g., a personal computer, a mobile phone, the Internet service, etc.) as well as to take the responsibility of paying all necessary charges (e.g., telephone service charges, the Internet service charges, etc.) by yourself.

3.5 You understand and accept that while using the services of GIT, it is required to use resources of your end device and bandwidth, which may be subject to additional charges that you agree to be liable for.

3.6 You understand and accept that you shall not take GIT’s product out to use or keep in any channel which is not provided by GIT, e.g., using other accessory device to access GIT’s product, unless permitted by GIT.

3.7 If you violate any service terms as indicated in Section 4, it shall be deemed that you have breached the Agreement and GIT has the right to suspend or withdraw your account or suspend your service immediately. In the case that any damage occurs, you are obliged to pay all damages arising from the Agreement breach to GIT in full.


4. Restrictions on Use

4.1 You affirm that you shall not engage in or conduct any of the following acts through the website and/or application of GIT.

(1) Any act that violates the rights of any third party; breaches the Agreement or your legal responsibilities to any third party; offends laws, peace or good morals, e.g., distributing, transferring, or publicizing content that conceal details which pose threats to national security and damage social stability, details that are insulting, defamatory, indecent, obscene, etc.

(2) Infringement of copyrights or intellectual property rights, trade secrets, and other rights of GIT, representatives of GIT, owners of copyrighted works, or any third parties, which include but not limited to sending a file that infringes a copyright or consists of or relates to copyright infringement, giving information of a user account or forwarding a user account to any third party, disseminating or distributing content with a copyright without permission, disseminating copyrighted content in public media.

(3) Distortion of truth, deceiving other people.

(4) Distribution, forwarding, sharing advertising content and junk information.

(5) Committing any acts in order to create materials containing viruses or computer codes; any data folders or programs that have been designed to destroy, intervene, or limit regular use of services or website and/or application or computer software or hardware.

(6) Any act that violates laws.

4.2 If you violate the provision stated in Section 5.1 and cause any third party or any government agency or any related agency to file a lawsuit or claim damages or request GIT to cooperate in proceeding such acts, you must be liable to all damages occurred and may occur to GIT as well as damages occurred to the third party.

4.3 You agree that you shall not use or implicate GIT’s products and services as well as reputation in any political activity, whatever the reason may be. In the case that you violate the terms and cause damages to GIT, GIT has the right to suspend the use of your account temporarily or withdraw your account without prior notice as well as the right to claim any damages arising from such violation.


5. Limitation of Liabilities

5.1 GIT reserves the right not to guarantee that the services of GIT shall be in accordance with your demand, and uninterrupted or without any errors or defects; as well as not to warrant that any content or information obtained from the use of the website and/or application of GIT is correct, reliable, or quality of the information or services of GIT shall be according to your expectation. The responsibility in using the services of GIT is solely yours. It shall be deemed that using the service of GIT is your discretion and you shall be liable to all damages that may occur from your access to such services.

5.2 You agree and accept that the services of GIT rely on technologies, conditions, and surrounding factors during the services. GIT shall use utmost efforts to provide the services to you. GIT reserves the rights not to be liable to damages or defects occurred from the following circumstances.

(1) Damages from computer viruses, Trojan horses, or other harmful programs and attacks, acts of hackers.

(2) Any acts that have occurred from instability of the Internet system, connection, devices, or third parties that are beyond the control of GIT in accessing the system without permission; causing damages to data or program; disturbing functionality of the computer system or network; accessing the system or network without permission; and data breach.

(3) You have violated the terms and conditions of the Agreement, e.g., allowing another user or a third party to access your user account.

(4) Other circumstances that are beyond GIT’s control or foresight.

5.3 You understand and accept that using the services under the Agreement may involve connecting to other websites or Internet information sources that are beyond GIT’s control. GIT reserves the right not to be liable to any damages or losses occurred from the websites and information sources and shall not hold any responsibility or obligation to other contents, advertisements, products or services, or any other contents presented on or through the websites or information sources. GIT shall not take any responsibility and obligation to information and communication with other websites that have been linked to GIT’s website and/or application. Connection to such third-party websites has been made solely to accommodate you. You are responsible to read and understand rules and conditions of the websites that you visit, and you are liable to damages occurred.

5.4 GIT reserves the right not to be liable to any damages, defects, or losses occurred due to force majeure that cannot be predicted, protected from, or avoided, which include but not limited to natural disasters, fire, flood, earthquake, disease outbreak, storm, war, riot, political activity, etc.

5.5 You agree and acknowledge that GIT shall not take any liability or obligation in the case of suspension or withdrawal of a business, a service system, or an agreement between GIT and a third party as well as GIT shall not be liable to damages that occurred from inaccessibility to GIT’s services, loss of data, or purchasing GIT’s products, or to any acts on the website and/or application of GIT due to the circumstances.


6. Advertising

6.1 You acknowledge that while using the services, GIT may present advertisements, public relations, or disseminate business and non-business information. The acts may be proceeded by GIT or a representative or a third party that is a representative of GIT. Modification of advertising format, means, and scope may be done by GIT, without giving you a prior notice.

6.2 You acknowledge that you have the responsibility to inspect accuracy and reliability of advertisement information that are presented on the website and/or application of GIT by yourself. You are also liable to any acts according to such advertisement information. GIT reserves the right not to hold any liability to any damages occurred from your acts related to the advertisements or contents presented by the advertisers.


7. Retention of User Personal Data

GIT prioritizes protecting privacy of users and shall protect your privacy and personal data provided to GIT. GIT have properly collected the data according to GIT’s “Personal Data Protection Policy”. GIT recommend reading the Personal Data Protection Policy thoroughly. You acknowledge that GIT may collect, use, or disclose personal data to proceed according to the purposes stated under the Personal Data Protection Policy which may include the use for the purposes of marketing, advertising, or other services that may interest you.


8. Intellectual Property

8.1 Any products under GIT’s services, e.g., characters, texts, graphics, logos, sounds, images, videos, computer software, diagrams, and any information that can be accessed through means of GIT Information Center on the website and/or application of GIT are deemed the intellectual properties of GIT and/or GIT has been legally permitted by the right’s owner to use the content in providing services through the website and/or application of GIT. GIT is protected by Thailand intellectual property law and in other countries. 

8.2 You agree and accept that in purchasing or downloading any product and/or content through the website and/or application of GIT you do not obtain the ownership of any intellectual property in the product and/or content.

8.3 You agree to comply with the intellectual property law and other relevant laws as well as restrictions presented on the website and/or application of GIT, and not to modify, alter, duplicate, imitate, forward, reverse engineer, display, involve in distribution, dissemination, or seek commercial benefit by any means to any product and/or content presented on the website and/or application of GIT, wholly or partly, unless you are clearly permitted by GIT or an individual with legal entitlement in the product and/or content or in the case that it is exempted by laws.

If GIT finds that there is a violation of law on the website and/or application of GIT, GIT has the right in proceed handling measures with you, your user account, and the violation immediately as GIT sees fit to suppress damages.

8.4 If any user violate any of the provisions as stated in Section 12, GIT has the right to terminate the services and rescind the Agreement with the user.  GIT reserves the right not to refund any fees or charges that the user has paid. GIT has the right to demand the user to pay for damages and the right to bring a lawsuit against the user according to laws.


9. Agreement Termination

9.1 GIT reserves the right to suspend, terminate, or delete your account as well as your access to any of the service without prior notice if GIT finds that any of the following circumstances arise.

(1) You have violated or committed any acts against the terms and conditions of the Agreement.

(2) You have provided false personal data to GIT for registration of GIT’s membership and/or services.

(3) GIT has to terminate the services according to an order of a court or an authorized government agency, or as promulgated by laws, or if there is any necessity to suppress damages that may occurred to GIT.

(4) GIT needs to terminate the service due to security or other compulsory circumstances.

9.2 In the event of agreement cancellation by the reason stated in Section 9.1 (1) and/or 9.1 (2) above if any damages arise from the cause of agreement termination, you must be liable to pay all damages in full, including any damages or costs occurred to GIT. If the damage compensation does not cover all damages occurred to GIT, GIT has the right to pursue legal action to demand you to pay for the damage with interests.


10. Amendment

10.1 In the event of necessity, GIT has the right to revise provisions of the Agreement. You can inspect the latest revision of the Agreement on GIT website’s page.

10.2 Using GIT’s services after the revision of the Agreement shall constitute your acceptance of such changes. However, if you do not accept or disagree with the revision, you may stop using the service of GIT immediately.


11. Applicable Laws and Jurisdiction Courts

11.1 The Agreement is conducted at the Gem and Jewelry Institute of Thailand (Public Organization).

11.2 Interpretation and enforcement of the Agreement shall be according to laws of Thailand and disputes risen from or related to the Agreement shall be under a jurisdiction court.

11.3 In the case that any section or provision of the Agreement cannot be enforced or becomes invalid, whatever the reason may be, it shall be deemed that other provisions and sections in the Agreement remain in full effect.
